Compensation for Tripping and Slipping Accidents

Perhaps the most common cause of an injury through an accident in the workplace is due to tripping or slipping. Because we often see such a fall as foolish or incompetent we tend to immediately blame ourselves – especially when the injuries are relatively minor.

However, the accident may not have been your fault at all and may have been due to the fact that your work environment had not been properly risk assessed for hazards. Also, even though trip and slip accidents sound somewhat minor, consequences can be severe (i.e. long term back problems or a breakage or fracture). When can I claim compensation?

Basically, you can claim compensation if you feel the injury you have suffered, after having a tripping or slipping accident in the workplace, was not your fault. It is the duty of your employer to frequently monitor your workplace for hazards such as trailing wires, uneven flooring, blocked walkways and unsafe work equipment. Your employer should also take into account transient occurrences likely to take place and create safe procedures to minimise resulting dangers. For instance if there is a spillage which an employee could slip and fall on, there should be a policy in place to prevent accidents.

Making a claim

If the incident occurred within the last three years you can make a claim for compensation. Clearly the more evidence you have about the claim the more likely you will win your case. So where possible obtain the following information:

Ensure the accident is reported and recorded in the accident book.
If possible take a photograph of the scene of the incident
Obtain the names of any witnesses.
Keep receipts and documents which evidence everything you might reasonably feel you have incurred as a result of the accident. This may include medication, travel expenses, records of loss of earnings etc.
