Compensation for Slips and Falls at Work

Unfortunately, even though your employer has responsibility to ensure your work environment is safe from hazards, slips and falls in the workplace are common. The name of the accident in itself tends to suggest small injuries but statistics show an incident can lead to life changing injuries and even fatalities.

My employer’s responsibilities

When ensuring the safety of any work environment an employer should be carrying out risk assessments and monitoring the safe state of repair of the building or site. This may include paying attention to trailing wires, damaged carpets and uneven ground or flooring. In analysing the safety of the building structure risks such as leaks from the roof (causing slippery walking surfaces) and the maintenance of such factors as handrails and anti-slip mats would need to be taken into account.

Adverse weather conditions or temporary incidents (such as product spillage) may cause a hazard which will need to have pre-considered processes in place to minimise accidents. This could include warning signs or the cordoning off of hazardous areas.

A risk assessment may also warrant the need of personal protective equipment or employee training.

Making a claim

We all have a responsibility to look after our own health and safety. In the workplace your employer also has ultimate responsibility to minimise hazards which could cause personal injury. Claims may be made in cases where it can be proved that an employer’s negligence of health and safety principles has resulted in avoidable injury to someone under their liability.

If the incident occurred within the last three years you can make a claim for compensation. Clearly the more evidence you have about the claim the more likely you will win your case. So where possible obtain the following information:

  • Ensure the accident is reported and recorded in the accident book.
  • If possible take a photograph of the scene of the incident
  • Get the names of any witnesses.
  • Keep receipts and documents which evidence everything you might reasonably feel you have incurred as a result of the accident. This may include medication, travel expenses, records of loss of earnings etc.
