Mesothelioma Compensation Claim

What is Mesothelioma?

Mesothelioma is a form of cancer which is caused by exposure to asbestos. The most common type of this illness is Pleural Mesothelioma which is triggered by inhaling asbestos fibres into the lungs. The sufferer is likely to experience difficult and painful breathing as a tumour begins to form on the lining of the lungs. The second and rarer type is called Peritoneal Mesothelioma where the tumour develops on the lining of the peritoneum (abdomen).

How can Mesothelioma be contracted in the workplace?

The illness is most commonly caused by breathing in asbestos dust. It can develop over a short period of time and be triggered by relatively low levels of asbestos in respect of other asbestos related illnesses.

Asbestos has now been banned because of its side effects, but after the Second World War it was used regularly to lag pipes and boilers and for insulation. Even now there are a great many properties built before 2000 which have asbestos in the building structure. Under health and safety regulations it is the duty of employers to ensure the environment where their employees will be working is made safe beforehand and constantly monitored.

Where the presence of asbestos is not monitored or removed, or proper personal protective equipment is not provided, Mesothelioma can be contracted. The more common job roles where there is a higher risk are boilermakers and laggers, pipe fitters and plumbers, joiners, carpenter, builders and electricians working on construction or building sites.

Making a claim

It should be taken into account that Mesothelioma may not appear straight away. You may have to go back several years to pin down its cause in some cases. Once your GP has diagnosed Mesothelioma you need to track back to determine the source of the illness. To make a compensation claim you will need to prove it was your employers fault.
