Falling Debris, Objects or Materials at Work

Accidents involving falling objects in the workplace often lead to claims for compensation in the courts. Incidents are more likely to occur in industrial settings such as factories, construction sites and warehouses.

If a falling object has caused personal harm and complications through no fault of your own, a personal injury claim may be considered. You may be eligible to make a claim if you have suffered an injury that was caused by a mistake or negligence by someone else. For example, if a colleague dropped an object from above or an employer neglected health and safety regulations in the workplace.

Your employers responsibilities to ensure your safety

It is the duty of your employer to facilitate on-going risk assessments in the workplace. The most important regulations which govern the safety of workers (and the public)in this respect are:

  • The Provision and Use of Work Equipment Regulations 1998 (PUWER)  This Act states that workers must be issued with the appropriate Personal Protective equipment (including headgear and steel toecaps on shoes) that are safe to use and suitable for the task in hand. Clearly it also takes into account the work environment where employees may be working i.e. below scaffolding where there may be a danger of falling objects.
  • The Personal Protective Equipment at Work Regulations 1992 (PPEW)  This Act goes one step further and focuses on the equipment itself: it should be maintained and in good working order.

Falling debris, objects and materials: Making a claim

In making a claim you may receive financial help in supporting you through the period of your injury. It may also help prevent further accidents happening as changes to health and safety measures are tightened at your place of work and within the industry itself. Employers expect there to be compensation claims and they therefore factor this into their budgets by covering themselves with Employers’ Liability Insurance. At our expert solicitors can guide you through the process.
